Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including severe burns, to employees in that employees were exposed to a dust explosion, deflagration, or other fire hazards from combustible grain dust in the processing of flour in the non-gluten free flour mill in building 2 that was connected to a fixed dust collection system and bag house located inside of the building. Ignition sources including electrical cords, power boxes, fixed lighting and propane forklift that were not properly rated as Class II, Division 1 electrical equipment were present with the Class II combustible grain dust that had a Kst value of 33.61 bar meter/second. a) Building 2, Gluten Flour Milling Machine dust collection system: On or about July 12, 2016, and prior to, the employer exposed employees to a combustible grain dust explosion and fire hazards and did not locate the dust collector outside of the building. b) Building 2, Gluten Free Flour Milling Machine dust collection system: On or about July 12, 2016, and prior to, the employer exposed employees to a combustible grain dust explosion and fire hazards and did not locate the dust collector outside of the building.
