29 CFR 1926.102(a)(1): Eye and face protective equipment was not used when machines or operations presented potential eye or face injury:     a) The employer allowed his employee to operate a pneumatic nail gun when installing new roofing materials while no wearing any eye and or face protection exposing the employee to eye and face injuries from flying debris.      Condition occurred on or about 07/13/2016.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:      a) The employer allowed his employee to install new roofing materials on the first floor porch roof of a two story home with no fall protection systems in place exposing the employee to fall hazards.     b) The employer allowed his employees to install new roofing materials on the main roof of a two story home with no fall protection systems in place exposing the employees to fall hazards.      Condition occurred on or about 07/13/2016.         Dario Lema dba Two Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1086195, citation number 2, item number 1 and was affirmed as a final order on 05/2/16, with respect to a workplace located at 29 Lehigh Avenue, Edison, NJ 08837.
