29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (A) At Blair Cedar & Novelty Works: Employees are exposed to noise levels higher than 85 dBA. The employer failed to establish a Hearing Conservation Program. (1) An employee working at the gang rip was exposed to continuous noise level at 101.1 % of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 90 dBA. The sampling was performed for 467 min during one shift on July 21, 2016; exposure calculation included a zero increment for the 13 minutes not sampled. (2) An employee working at the Line saw was exposed to continuous noise level at 84.8 % of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 88.8 dBA. The sampling was performed for 466 min during one shift on July 21, 2016; exposure calculation included a zero increment for the 14 minutes not sampled. (3) An employee working at the Finish Sander was exposed to continuous noise level at 75.3 % of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 87.9 dBA. The sampling was performed for 460 min during one shift on July 21, 2016; exposure calculation included a zero increment for the 20 minutes not sampled. (4) An employee working at the Line Saw was exposed to continuous noise level at 124.8 % of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 91.5 dBA. The sampling was performed for 440 min during one shift on July 21, 2016; exposure calculation included a zero increment for the 40 minutes not sampled.
