29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:    a.  On or about July 14, 2016, on the West side of the Bil-Jax fabricated step frame scaffold, the platform at the upper working/walking level of the scaffold was not fully planked or decked, thereby exposing employees to a fall hazard of over 20 feet.    b.  On or about July 14, 2016, on the East side of the Bil-Jax fabricated step frame scaffold, the platform at the upper working/walking level of the scaffold was not fully planked or decked, thereby exposing employees to a fall hazard of 23.75 feet or more.    c.  On or about July 14, 2016, on the West side of the Bil-Jax fabricated step frame scaffold, the platform at the working/walking level where the employee fell from the scaffold was not fully planked or decked, thereby exposing the employee to a fall hazard of over 15 feet.

29 CFR 1926.451(g)(1)(vii):  For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:   a.  On or about July 14, 2016, on the West side of the Bil-Jax fabricated step frame scaffold, employees using the upper platform were not protected by the use of personal fall arrest systems or guardrail systems, thereby exposing employees to a fall hazard of over 20 feet.   b.  On or about July 14, 2016, on the East side of the Bil-Jax fabricated step frame scaffold, employees using the upper platform were not protected by the use of personal fall arrest systems or guardrail systems, thereby exposing employees to a fall hazard of 23.75 feet or more.   c.  On or about July 14, 2016, on the West side of the Bil-Jax fabricated step frame scaffold, an employee who fell from the scaffold while using the platform as a walking/working level while coming down was not protected by the use of a personal fall arrest system or guardrail system, thereby exposing the employee to a fall hazard of over 15 feet.

29 CFR 1926.451(g)(2):  Effective September 2, 1997, the employer shall have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds.  Employers are required to provide fall protection for employees erecting or dismantling supported scaffolds where the installation and use of such protection is feasible and does not create a greater hazard:   a.  On or about July 14, 2016, the employer did not determine the feasibility and safety of providing fall protection and ensuring the use of fall protection for an employee dismantling the Bil-Jax fabricated step frame scaffold, thereby exposing the employee to a fall hazard of over 20 feet.

On or before July 14, 2016, the employer did not ensure that an employee performing work on a Bil-Jax fabricated step frame scaffold received scaffold training on the hazards from a qualified person, thereby exposing the employee to a fall hazard of over 20 feet.

The training shall include the following topics, as applicable:    a.  On or before July 14, 2016, the employer did not ensure that an employee performing disassembly of a Bil-Jax fabricated step frame scaffold received scaffold training on the hazards from a competent person, thereby exposing the employee to a fall hazard of over 20 feet.

On or before July 14, 2016, the employer did not develop and implement a written hazard communication program for an employee who used chemicals such as, but not limited to, the following:  Sherwin-Williams Duration acrylic paint.
