Section (5)(a)(1): The employer failed to furnish to each of his employees a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm, in that employees were exposed to struck-by hazards from material handling equipment:    (a) On or about July 7, 2016 for an employee who was struck-by a JLG Skytrak while acting as a ground guide for a suspended load at the project located in the vicinity of 801 22nd Avenue West in West Fargo, North Dakota.    Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the guidelines set forth in ANSI/ITSDF B56.6-2005, particularly paragraph 6.2.6, which states that the operator should "Exercise particular care during backing or other operations where a pedestrian could step into the path of travel of the truck", and paragraph 6.2.7, which states "Do not allow anyone to stand or pass under the elevated portion of a rough terrain forklift, whether empty or loaded."
