29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  29 CFR 1910.178(l)(2)(ii) is applicable to shipyard employment by 29 CFR 1915.120 that incorporates the general industry requirements.  Thunder Bay Shores Marine Inc., employees required to operator forklifts were not provided training on the safe operation of forklifts that included formal instruction, practical training and an evaluation of the operator's performance in the workplace.

29 CFR 1910.305(b)(1)(ii): Unused openings in boxes, cabinets, or fittings were not effectively closed:    The employer failed to ensure unused openings (knockouts) in boxes and cabinets were effectively closed:  In the shop, in Bay 1 employee restroom, the employer did not ensure three unused openings in circuit breaker panel were covered, there by shock and or fire hazard. Additionally, two opening on the left side of the panel were not effectively closed.
