29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: On or about July 14, 2016, during the replacement of a residential sanitary sewer line at 347 East Washington Street, Chagrin Falls, Ohio, the employer did not ensure employees working inside a trench were protected from the excavated material that posed a hazard of falling or rolling into an excavation, by placing and keeping the material at least 2 feet from the edge of a trench or by the use of a retaining device.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about July 14, 2016, during the replacement of a residential sanitary sewer line at 347 East Washington Street, Chagrin Falls, Ohio, the employer did not ensure employees working inside a trench, with varying depths of approximately 6 feet to approximately 8 feet deep and near 90 degree vertical walls, were protected from cave-ins by an adequately designed protection system. The soil was classified as Cohesive Sandy Clay, type B.
