29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about July 26, 2016 employees were cutting materials and framing interior walls on a new second floor addition. The balcony doors had not yet been installed and the openings were not protected by any means of guardrails, or safety nets exposing the employees to falls in excess of 12 feet to the ground below.

29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented. a). On or about July 26, 2016 employees were constructing a leading edge by installing plywood decking on the third floor deck trusses and were not protected by any means of personal fall protection, guardrails or safety nets, exposing employees to falls in excess of 14 feet to the ground below.
