29 CFR 1910.147(c)(1):   The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  The employer is failing to protect employee from the hazards of unexpected start up or energizing of equipment.  This was most recently observed on July 26, 2016 at 3858 N. 65th Street, Omaha, Nebraska  68105.  The employer is failing to establish and maintain an adequate energy control program for technicians who perform work on equipment located in properties the company manages.  Equipment that is maintained by the company includes but is not limited to heating and air conditioning units (HVAC), Water Heaters, clothes washer, dryer, electrical, water and natural gas systems within the properties etc. Most of this equipment maintained by the employees has a single energy source and would not require the development of written specific procedures.  The employees currently utilize lockout/tag out when performing maintenance.

29 CFR 1910.1200(e)(1):   Employer had not developed or implemented a written hazard communication program including the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  The employer is failing to protect employees from the hazards of chemical exposure.  This was most recently observed on July 26, 2016 at 5015 Dodge Street, #200, Omaha, Nebraska  68132.  The company is not maintaining a written hazardous communication program in accordance with this sub-part. The employees utilize oils, lubricants and refrigerants as part of their routine duties.  Training on those substances has been accomplished.
