29 CFR 1910.26(c)(2)(vii): Ladders having defects were not marked and taken out of service until repaired by either maintenance department or the manufacturer.    (a) Aisle 14 - On or about June 26, 2016, the employer did not remove a portable metal ladder from service. The top rail was missing exposing employees to fall hazards.     In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

(b) Inventory Department -  On or about July 26, 2017, the employer did not ensure that the Nissan sit down forklift was equipped with legible nameplate. (a) Facility Wide - On or about July 26, 2016, the employer did not ensure that powered industrial vehicles were examined at least daily before being placed in service. Forklift inspections were performed on a weekly basis.
