29 CFR 1910.138(b): The employer did not base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified: (a) JM Auto Service and Collision Center, 3280 Chambers Road Aurora, Colorado 80011: On and before July 27, 2016, the employer did not base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified. Employees worked in the spray booth and mixing room performing finishing operations for auto collision repair. Employees wore Nitrile exam gloves while cleaning their spray guns with Finish1 Economy Thinner. Employees were exposed to chemical hazards.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2): (a) JM Auto Service and Collision Center, 3280 Chambers Road Aurora, Colorado 80011: On and before July 27, 2016, the employer did not verify that the required workplace hazard assessment had been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d). Employees work in the auto body shop as welders, painters, and laborers performing auto collision repair. The employer has implemented work rules for the use of PPE; however a workplace assessment has not been performed and certified by the employer. Employees performed painting, grinding, and welding operations where they were exposed to physical and chemical hazards. Abatement Note: The employer shall verify that the required workplace assessment has been performed through a written certification that shall include the following: 1) Identifies the workplace evaluated; 2) The person certifying that the evaluation has been performed; 3) The date(s) that the hazard assessment was performed; and 4) Which identifies the document as a certification of hazard assessment.

29 CFR 1910.134(c)(1): 29 CFR 1910.134(c)(1): The employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix) of 29 CFR 1910.134, in that employees were required to wear respirators during work operations: (a) JM Auto Service and Collision Center, 3280 Chambers Road Aurora, Colorado 80011: On and before July 27, 2016 the employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix) of 29 CFR 1910.134, in that employees were required to wear respirators during work operations. Employees wore 3M half face tight fitting respirators during painting operations. This condition exposed employees to respiratory hazards. (b) JM Auto Service and Collision Center, 3280 Chambers Road Aurora, Colorado 80011: On and before July 27, 2016 the employer did not establish and maintain a written respiratory protection program, as specified in subparagraphs (c)(1)(i) through (ix) of 29 CFR 1910.134, in that employees were required to wear respirators during work operations. Employees wore 3M half face tight fitting respirators during sanding and grinding operations. This condition exposed employees to respiratory hazards. Abatement Note: The written program shall include at least the following: (1) Procedures for selecting respirators for use in the workplace; (2) Medical evaluations of employees required to use respirators; (3) Fit testing procedures for tight fitting respirators; (4) Procedures for proper use of respirators in routine and reasonably foreseeable emergency situations; (5) Procedures and schedules for cleaning, disinfection, storing, inspection, repairing, discarding, and otherwise maintaining respirators; (6) Procedures to ensure adequate air quality, quantity, and flow of breathing air for atmosphere-supplying respirators; (7) Training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situation; (8) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance; and (9) Procedure for regularly evaluating the effectiveness of the program
