29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a)Intersection of Hwy 90 and Irvington - Bayou La Batre Road, AL:  Employees were exposed to cave in hazards while working inside a trench that was 12 feet in depth, 14 feet in width and 40 feet and 6 inches in length that was dug in class B soil. The employer failed to provide a ladder or means of egress for every 25 feet.

The spoil pile located on the west wall of the trench was placed on the edge of the trench less than 2 feet and is approximately 7 feet high.
