Section 5(a)(1) of the Occupational Safety and Health Act of 1970:      The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck by and caught between hazards associated with operating powered industrial trucks. .  The employer is failing to protect the employees from caught between and struck by hazards associated with employees operating an all-terrain utility vehicle (ATV) across uneven terrain across the bottom of a landfill.  The most recent example of this was found at the facility located at the Lancaster County Landfill, 6001 Bluff Road, Lincoln, NE.     FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO CORRECT THIS HAZARD INCLUDES BUT IS NOT LIMITED TO:   a.     The employer should have instituted a deliberate and thorough training program on the operations of the ATV across uneven terrain in the bottom of a landfill specific to the work environment v. recreational use.

29 CFR 1904.39(a)(2):     The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:    On or about July 15, 2016, the employer failed to report to OSHA an in-patient hospitalization of on an employee. The employer has failed to report an in-patient hospitalization to OSHA within 24 hours.  This most recent occurrence of this took place at the facility located at Lancaster Landfill 6001 Bluff Road, Lincoln, NE where on July 15, 2016 the employer had employees using the ATV in lieu of larger company ½ ton and ¾ ton pick-up trucks as means of hauling the dirt, rocks and debris across the bottom of the landfill when the operator accelerated while simultaneously making a sharp left turn.  The result was the ATV rocked uncontrollably, eventually flipping onto its right side pinning the right leg of the passenger underneath. The injured employee was taken via ambulance to Bryant West Hospital where they were admitted and treated that same day.  The employer late reported the incident to OSHA on July 26, 2016.
