29 CFR 1910.178(l)(2)(iii): Operators training and evaluation was not conducted by persons who have the knowledge, training, and experience to train powered industrial truck operators and evaluate their competence:    (a) On or about August 5, 2016, at the Best Service Stores facility #156-4 in Kansas City, MO., the employer did not ensure that all Powered Industrial Truck Operators had been trained in accordance with this standard, in that all operators had been certified by persons who did not have the knowledge, training and experience to train and complete the performance evaluation required of each operator.       Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition       (a) On or about August 5, 2016, at the Best Service Stores facility #156-4 in Kansas City, MO., employees were exposed to serious injuries, in that the Toyota Powered Industrial Truck , Serial Number #13881 was in operation with an inoperable/defective emergency brake. When tested, the emergency brake would not operate and hold as required in neither forward or reverse gear.      Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.
