29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.     Throughout facility - On or about August 05,2016, employees (full-time / temporary) were required to operate / maintain / repair equipment without adequate lockout / tagout procedures. The employer did not establish an energy control program for machine operators and / or maintenance employees  performing product changes on rotary filler machines and other hardwired equipment. Employees hands / fingers were exposed to injury associated with the unexpected reenergization of equipment.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.     Throughout facility - On or about August 05, 2016, employees (full-time / temporary) were required to operate powered industrial vehicles in the performance of their duties. Operators were not trained in the safe operation of powered industrial trucks, thereby exposing employees (full-time / part-time / temporary) in the facility to struck by hazards.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

On or about August 05, 2016, at the above addressed jobsite, employees were required to work with hazardous chemicals including, but not limited to sulfuric acid, bleach, and sanitizer. The employer failed to develop a written hazard communication program with the minimum criteria listed above. Employees were there by exposed to chemical burns and skin irritation.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.    a. On or about August 05, 2016, at the above located workplace, employees working near the in-line and rotary filler machines were exposed to hazards associated with excess chemical exposure. These hazards necessitated the use of personal protective equipment such as splash shields, latex gloves, and respiratory protection to prevent occupational illnesses. The employer had not verified, through written certification, that a hazard assessment had been performed.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  Throughout facility - On or about February 24, 2014, employees (full-time / temporary) were required to operate powered industrial vehicles in the performance of their duties. The employer did not perform an examination of the Mitsubishi model FB18PNT, serial number EFB2600385 / Mitsubishi model FBC25N2, Serial number AFB3050344, to check for defects prior to / or after each shift, thereby exposing employees to struck by hazards.
