29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift:      a) On or about May 28, 2016 and at times prior, Klingbeil Capital Management, as the controlling employer, did not ensure that the employee of Masterpiece Roofing and Painting (subcontractor) used a fall restraint system to prevent falls to a lower level while working in the basket of an aerial lift.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:      a) On or about May 28, 2016 and at times prior, Klingbeil Capital Management, as the controlling employer, did not ensure that employees of Walters Mechanical LLC were protected from falls hazards of approximately 10 feet high. Employees use the stairs to access and egress the second and third levels of the building which were not installed with stair rails.
