29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and regulatory requirements for controlling and eliminating hazards in the workplace:       Location: 1228 York Ave, New York, N.Y.      On or about 8/8/2016          a)   Employees were not instructed on the hazards of using a hydraulic jack, chain rigging and mooring arm to stabilize and move a barge crane.          NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.251(a)(1):  Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it is safe:   (or citing in the alternative standard 1926.20(b)(2))      Location: 1228 York Ave, New York, N.Y.      On or about 8/8/2016      a)  Employer did not inspect to determine the amount of working load the hydraulic jack may be exposed to when pulling the crane barge.         b)  Employer did not inspect to determine safety requirements of the jack including cotter pin function, and preventing side-loading of cast iron shackle ears.      c)  Employer did not inspect to ensure the cotter pins of the jack are in place before activating each jack pull cycle.      d)  Employer did not inspect to ensure employees were in safe zone before activating each jack pull cycle.      NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
