29 CFR 1926.501(b)(13): 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: a. On August 23, 2016, on the 6:12 pitch roof, employees performing framing work were not protected from a 22 feet fall hazard by the use of a fall protection system. b. On August 23, 2016, on the 2nd floor, the railing around the stairway opening did not have a midrail, exposing employees to a 12 feet fall hazard.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not marked in a manner that readily identified them as defective, tagged with "Do Not Use" or similar language, or withdrawn from service until repaired: a. On August 23, 2016, 2nd rung on the ladder used to access the 2nd floor had a broken rung, exposing employees to a trip hazard.
