The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Workers were observed engaged in residential construction activities removing an existing roof which contained 15% Chrysotile asbestos shingles. Employees were exposed to potential fall hazards in that the workers were not properly trained in fall protection criteria.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. Workers were observed engaged in residential construction activities removing an existing roof which contained 15% Chrysotile asbestos shingles. Employees were exposed to potential fall hazards and exposure to asbestos hazards and regular and frequent inspections by a competent person was not conducted to ensure that the jobsite, materials, and equipment such as fall protection systems and proper asbestos abatement methods were maintained and utilized in a safe manner. The P-1 Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.20(b)(2), which was contained in OSHA inspection number 550878, citation number 1, item number 1 and was affirmed as a final order on (September 7, 2012), with respect to a workplace located at 211 E. Orchard Ave., Lebanon, OH 45036.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Workers were engaged in residential construction activities removing an existing roof on a single-family house. Workers were exposed to potential 21.0 foot fall hazards in that a proper fall protection system was not utilized. 29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.
