29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  a) ASARCO Hayden Smelter: Employees were exposed to arsenic, sulfur dioxide, lead, cadmium, other metal fumes and dust while cleaning equipment where there was no hazard assessment completed to determine the appropriate personal protection equipment.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  a) ASARCO Hayden Smelter: The employer did not develop, implement and maintain a written hazard communication program at the site. Employees cleaning the concentrated material at the Converter Baghouse area were not trained on the hazards associated with these activities.   NOTE:  A comprehensive hazard communication program needs to include the following required elements:  1) A written program specific to the company.  2) Material safety data sheets.  3) A hazardous chemical inventory list.  4) Labeling of all containers.  5) Documented employee training.
