29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) SOUTH END OF TRENCH - Employees performed work in trench that measured approximately 71 inches deep, and the employer failed to place the spoil pile a minimum of two feet from the edge of the trench where the spoil pile was observed right at the edge, thereby exposing the employees to engulfment hazards, on or about August 23, 2016. No abatement certification or documentation required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): (a) SOUTH END OF TRENCH - The employer did not adequately bench or slope the trench where employee(s) had been drilling holes in the side of a 48 inch drain pipe, thereby exposing the employee(s) to cave-in hazards while working at a depth of approximately 5 foot 11 inches, on or about August 23, 2016. No abatement certification or documentation required.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) SOUTH END OF TRENCH - The employer failed to identify conditions in the trench that presented hazards to employees, including but not limited to the spoil pile not a minimum of two feet from the edge of the trench and the need for protective systems to protect employees working at depths deeper than five feet, on or about August 23, 2016. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
