29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial vehicle.  (a) Waisner Construction Company dba Holgate Lumber Co. on or about August 23, 2016, at the address of 19551 Dixie Hwy Bowling Green, OH: The employer did not ensure employees were formally trained in the operation of the Skytrack model 5028 extending boom forklift. An evaluation of competency for the employees operating the stated forklift was not conducted and documented by the employer. The employees operating and others working around the forklift were potentially exposed to struck-by injuries due to operation by an unevaluated operator.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) Waisner Construction Company dba Holgate Lumber Co. on or about August 23, 2016, at the address of 19551 Dixie Hwy Bowling Green, OH: The employer did not ensure employees were protected from a fall while working from a forklift supported scaffold. The employees utilizing the platform to access the roof level and to fasten siding material without any fall protection in place were exposed to falls up to 16 ft. to the ground below.

During this activity, employees were exposed to falls up to 16 ft. to the ground below.
