OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards during operation of a JLG telehandler    (a)    During masonry work:  On or prior to 9/7/16, an employee operating a JLG G9-43A telehandler was moving loads through a window opening with limited clearance, exposing employees working in the building to struck-by and collapse hazards in the event the boom or load struck the building.    On the morning of 9/7/16, employees of JDR Masonry and Merit Plumbing and Heating LLC were exposed to struck-by hazards when a JLG telehandler operated by JDR masonry struck a W16x31 steel lentil, dislodging the lentil and causing two of the four unsecured joists to fall.
