29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:       (a) On or about 9/8/2016 at DOOB USA 3D retail LLC located at 220 36th Street 4th Floor Suite B424 Brooklyn, NY 11232, workers are required to wear a 3M half-face respirator with an organic vapor and particulate cartridges ; the employer did not establish and develop a respiratory protection program.       NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER  IS REQUIRED TO SUBMIT ABATEMENT  DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:       (a) On or about 9/8/2016 at DOOB USA 3D retail LLC located at 220 36th Street 4th Floor Suite B424 Brooklyn, NY 11232, workers are required to wear a 3M half-face respirator with an organic vapor and particulate cartridges ; the employer did not conduct a medical evaluation of employees prior to requiring respirator use in the workplace.        NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER  IS REQUIRED TO SUBMIT ABATEMENT  DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:      (a) On or about 9/8/2016 at DOOB 3D Inc. located at 220 36th Street 4th Floor Suite B424 Brooklyn, NY 11232, workers conducting three dimensional printing operations were exposed to hazardous chemicals such as but not limited to acetone, toluene, and propane without being provided training on these hazardous chemicals by the employer.        NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY.
