29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, and indications of failure of protective systems:  a)  Cheaper Rooter at 7222 Ivy Street, Commerce City, CO 80022:  On September 19, 2016, the employer did not ensure that a competent person conducted an inspection of the trench prior to allowing employees to work in it.  The employer used a Bobcat excavator model E35 to dig a trench to look for a sewer tap.  The trench was approximately 8 feet deep, 3 feet 2 inches wide, and 13 feet long.  The trench had vertical walls, and the soil consisted of Type B silty sand.  No sloping, benching, or shielding was in place.  One wall caved in while an employee was working in the trench.  An immediate rescue allowed the employee to escape the cave-in.  The employee experienced lower body injuries.  This condition exposed the employee to a cave-in hazard.

The trench was approximately 8 feet deep, 3 feet 2 inches wide, and 13 feet long.  The trench had vertical walls, and the soil consisted of Type B silty sand.
