OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazard of falling from height:  a.  At the grain leg access ladder, on or about 9/28/16:  The ladder accessing the grain leg was not equipped with a safety cage until thirty feet in height.  The ladder was also not equipped with any type of ladder climbing safety device.  Fall hazard of thirty feet:  Among other methods, one feasible and acceptable abatement method to correct this hazard is to:  Ensure the grain leg access ladder has a ladder cage that is seven feet above the ground at a minimum as specified in paragraph 8.1.5 of ASAE S412.1 which states Ladder cages shall begin not less than 2100 mm (7 ft.) nor more than 2400 mm 8 ft.)  above the bottom of the ladder.... Or, install a ladder safety device as specified in paragraph 10.1 of ASAE S412.1 which states A ladder safety device is any device , other than a cage or well, designed to eliminate or reduce the possibility of accidental falls and which may incorporate such features as life belts, friction brakes and sliding attachments.  Abatement certification must be submitted for this item.
