29 CFR 1926.416(b)(2): Working spaces, walkways, and similar locations were not kept clear of cords which created a hazard to employees: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are keeping the ladder free from hazards. This most recently occurred on October 3, 2016 on the jobsite located at 20801 Plum St, Elkhorn, NE 68022. Employees are utilizing a single ladder to access and egress a roof that has and eave to ground height of about 9 feet. There is an extension cord wrapped around the sides and rungs at the top half of the ladder creating a trip hazard to employees.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer is failing to ensure that all employees are protected from fall hazards when accessing and egressing the landing surface of a residential roof. This most recently occurred on October 3, 2016 on the jobsite located at 20801 Plum St, Elkhorn, NE 68022 where the employer had employees using an extension ladder to re-roof the residential home. The ladder being used did not have the side rails extended to at least 3 feet beyond the landing surface which is approximately 9 feet above the ground.

29 CFR 1926.1060(a)(1)(i): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the nature of fall hazards in the work area: The employer is failing to train the employees to recognized fall hazards associated with using a ladder to access and egress a roof of an existing residential home. This most recently occurred on October 3, 2016 on the re-roofing jobsite located at 20801 Plum St, Elkhorn, NE 68022 where the employer had untrained employees using an extension ladder as a means to access/egress the roof which has an eave to ground height of approximately 9 feet. The ladder being used was not extended a minimum of three feet over the upper landing surface as it only extended approximately 2 feet. Also, the ladder was not kept free from tripping hazards as there was an extension cord wrapped around the sides and rungs.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on October 3, 2016 on the jobsite located at 20801 Plum St, Elkhorn, NE 68022. Employees were observed reroofing a residence on a 10:12 pitched roof at heights greater than 6 feet above the ground below. Esber Huitron Contreras Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1925.501(b)(13), which was contained in OSHA inspection number 952739, citation number 1, item number 1, and was affirmed as a final order on March 20, 2014, with respect to a workplace located at 5503 171st Street, Omaha, NE 68116.
