29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    a) At the facility, on or about October 6, 2016 - The employer failed to establish a written respirator program. Employees voluntarily wear a 3M Dual Cartridge air purifying respirator while torch cutting.

29 CFR 1910.134(e)(6)(i): The employer did not obtain from the physician or other licensed health care professional (PLHCP)  a written recommendation regarding the employee's ability to use the respirator:  a) At the facility, on or about October 6, 2016 - The employer failed to obtain from a PLHCP a written recommendation regarding a torchman's ability to wear a 3M Dual Cartridge air purifying respirator. The torchman voluntarily wears a 3M Dual Cartridge air purifying respirator while torch cutting.

29 CFR 1910.253(b)(5)(ii)(D): Cylinders were not secured on a special truck, regulators were not removed and valve protection caps, when provided for, were not put in place before cylinders were moved:    a) On the ferrous side of the scrap yard, on or about October 6, 2016 - The employer failed to remove the regulator on a propane tank when the tank was moved in the back of a minivan. The propane tank is used during torch cutting of scrap.    b) On the ferrous side of the scrap yard, on or about October 6, 2016 - The employer failed to remove the regulator and valve protection caps were not put in place on an oxygen tank when the tank was moved in the back of a minivan. The oxygen tank is used during torch cutting of scrap.
