29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. On or about October 6, 2016 and at times prior thereto, the employer did not perform frequent and regular inspections for safety hazards such as but not limited to; fall hazards. Employees were exposed to these and other hazards at the commercial property under construction.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who was on a walking/working surface with an unprotected side or edge more than 15 feet* (4.6m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: On or about October 6, 2016, five subcontracted employees were installing metal roofing on the commercial property under construction and were not utilizing a complete fall protection system, exposing employees to a fall hazard of approximately 24 feet.
