29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) 1735 E. Canal Rd, Dover PA - On or about October 4, 2016, an employee entered and worked in a trench measuring 6 feet - 8 inches deep that was not protected from cave-ins by an adequate protective system. Employee(s) had not been provided effective information and training on recognizing and avoiding cave-in hazards on the work site. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Canal Rd, Dover PA - An employee was connecting a sewer lateral line in a trench approximately 50 feet long x 2 feet wide, and 6 feet - 8 inches deep with spoil piles at the edge of the excavation, on or about October 4, 2016. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation that was more than 5 feet deep and not in stable rock was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: This employer does not provide adequate cave-in protection for employees working in excavations that are more than five feet deep and not in stable rock. This failure to provide adequate protection was most recently demonstrated on or about October 4, 2016. a) 1735 E. Canal Rd, Dover PA - On or about October 4, 2016, an employee working in a trench was not adequately protected against cave-ins in that the walls of the trench were not properly sloped, shored, benched or otherwise adequately protected against collapse. The employee was connecting a sewer lateral line within a trench measuring approximately 50 feet long x 2 feet wide, and 6 feet - 8 inches deep. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
