OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat while working outside on concrete operations:    (a) Washington and Dowling, Incorporated - On or about July 25, 2016, employees working outdoors on the concrete crew were exposed to heat which can cause heat-related illness(es) not limited to heat exhaustion and heat stroke.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1904.29(a): The employer did not use an OSHA 300, 301 and 300A Form or equivalent  (a) Washington and Dowling, Incorporated - The employer had three (3) recordable injuries during the calendar year 2016 which were not recorded on the OSHA 300 form, on or about October 12, 2016.  Abatement Certification and Documentation is required  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
