29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by a competent person prior to the start of work and as needed throughout the shift. Inspections were not made after every rainstorm or other hazard increasing occurrence:  a) Residential jobsite: On October 12, 2016 and at times prior thereto a competent person for trenching and excavation work had not evaluated the soil type/condition to determine the proper cave-in protective system to use and ensure it was in place as needed.  A cave-in protective system was not in place prior to allowing employees to work near nine foot vertical walls of the excavation.  The employer did not recognize the potential hazards of the unsupported nine foot vertical walls and take action to minimize the hazard.    b) Residential jobsite: On October 11, 2016 and at times prior thereto a competent  person for trenching and excavation work had not evaluated the placement of the spoil piles prior to allowing employees to work in the excavation.  The spoil piles were placed on the east and west side of an earthen ramp along the edges of an excavation, and were not at least two feet back from these areas. The employer did not recognize the potential hazards of the placement of the spoil piles and did not take action to minimize the hazard.      c) Residential jobsite: On October 11, 2016 and at times prior thereto a competent person for trenching and excavation work had not evaluated the condition of the soil on the east side of the excavation.  Cracking and sluffing of the excavated area was present.    NOTE) Certification of corrective action is required for this item.   Note) An OSHA "competent person" is defined as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
