29 CFR 1926.101(a): Ear protective devices were not provided when it was not feasible to reduce noise levels or duration of exposures to those specified in Table D-2, Permissible Noise Exposure, in 29 CFR 1926.52:    (a) Shear Grill's Construction Corp. employees, jackhammering the sidewalk of 3355 Broadway, New York, NY 10031, were exposed to noise dose above 194 % which corresponds to an 8hr. TWA of 94.8 dB. The employees were not provided with hearing protection devices. The condition was noted on or about October 11, 2016.     NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
