29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59)    a) On or about 8/18/16 at JEK Communications Inc., employees were exposed to chemicals such as but not limited to silica, and were not provided with material safety data sheets for these chemicals.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:  a) On or about 10/12/16 JEK Communications Inc., with a worksite between Rugby Road and Coney Island Ave along Ditmas Ave failed to ensure that employees performing concrete cutting operations utilized and were provided with appropriate personal protective equipment such as safety glasses, hearing protection, and respiratory protection when exposed to hazardous conditions including but not limited to noise, silica dust, and flying debris.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees.    a) On or about 10/12/16 JEK Communications Inc., with a worksite between Rugby Road and Coney Island Ave along Ditmas Ave failed to ensure that personal protective equipment such as but not limited to gloves and ear plugs at no cost to employees thereby exposing them to workplace hazardous.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
