29 CFR 1910.1200(d)(3)(ii): When classifying mixtures they produced or imported, chemical manufacturers and importers of mixtures relied on the information provided on the current safety data sheets of the individual ingredients when the chemical manufacturer or importer knew or in the exercise of reasonable diligence should have known, that the safety data sheet misstated or omitted information required by 29 CFR 1910.1200: a) On or about October 17, 2016, the employer failed classified mixtures they produced and to have a Safety Data Sheet (SDS) for the Red Flare (candle) mix, DWG 53711-8324659, while relying on the individual Material Safety Data Sheets (MSDSs) of the components of the mixture that did not have all the information required 1910.1200, including but not limited to the hazard classification.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: a) On or about October 17, 2016, the employer failed to have a Safety Data Sheet (SDS) for the Solvent Red 1, while relying on the Material Safety Data Sheets (MSDSs) that did not have all the information required, including but not limited to the hazard classification and toxicological information. b) On or about October 17, 2016, the employer failed to have a Safety Data Sheet (SDS) for the Solvent Red 135, while relying on the Material Safety Data Sheets (MSDSs) that did not have all the information required, including but not limited to the hazard classification. c) On or about October 17, 2016, the employer failed to have a Safety Data Sheet (SDS) for the Diatomaceous Earths , while relying on the Material Safety Data Sheets (MSDSs) that did not have all the information required, including but not limited to the hazard classification. d) On or about October 17, 2016, the employer failed to have a Safety Data Sheet (SDS) for the Magnesium Carbonate, while relying on the Material Safety Data Sheets (MSDSs) that did not have all the information required, including but not limited to the hazard classification.

29 CFR 1910.141(d)(1): Washing facilities were not maintained in a sanitary condition: a) On or about October 17, 2016, in the blending building, the women's showers, were use as storage for cleaning equipment and dirty clothing. Employees working in building #112 were unable to wash/remove residues of chemicals off their skin/bodies, including but not limited to Potassium Chlorate, Solvent Red 1, Solvent Red 135 and Diatomaceous Earths exposing them to potential skin and respiratory hazards. b) On or about October 17, 2016, in the blending building, the men's showers, were use as storage for cleaning equipment and dirty clothing. Employees working in building #112 were unable to wash/remove residues of chemicals off their skin/bodies, including but not limited to Potassium Chlorate, Solvent Red 1, Solvent Red 135 and Diatomaceous Earths exposing them to potential skin and respiratory hazards.
