29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a) 555 Jake Buncombe Road, Waco, GA, South trench: On or about October 24, 2016, the employer exposed an employee to cave-in hazards, in that the employer did not provide training to an employee working in an unprotected trench (9-feet, 3-inches deep), about the hazards that could result in physical harm and/or death.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:    a)  555 Jake Buncombe Road, Waco, GA, South trench: The employer exposed an employee to cave-in hazards while working inside an unprotected trench (350-feet long, 5-feet wide and 9-feet, 3-inches deep) to install 36 inch bell-type pipes as drainage for construction of four chicken houses.
