29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a.  On or about October 28, 2016, at the jobsite located at 218 E. South Island Street Appleton, WI, the employer did not have a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures for employees using abrasive blasting methods to remove lead based paint in the west stairwell.  All provisions of 29 CFR 1910.134(c) through (o) must be covered in a respiratory protection program.  Key elements include, but are not limited to the following:      1.  Selection of respirators for employees.     2.  Medical evaluations of employees.     3.  Fit testing.     4.  Training and information.     5.  Recordkeeping.

29 CFR 1926.62(e)(2)(i): Prior to commencement of the job each employer shall establish and implement a written compliance program to achieve compliance with paragraph (c) of this section:  a.  On or about October 28, 2016, at the jobsite located at 218 E. South Island Street Appleton, WI, the employer did not establish and implement a written compliance program prior to performing an employee exposure assessment which would ensure that employees engaged in removal of lead based paint using an abrasive blasting method are protected from lead exposure in excess of 2,500 micrograms per cubic meter (50 x PEL).  All provisions of 29CFR 1926.62(e)(2)(ii)[A] through [H] must be covered in a written compliance program.  Key elements include but are not limited to the following:      1.  A description of each activity in which lead is emitted.     2.  A description of the specific means that will be employed to achieve compliance.     3.  Air monitoring data which documents the source of lead emissions.     4.  A work practice program which includes items required under paragraphs (g) Protective work clothing and equipment, (h) Housekeeping, and (i) Hygiene facilities and practices.     5.  A description of arrangements made among contractors on multi-contractor sites with respect to informing affected employees of potential exposure to lead.

29 CFR 1926.62(j)(1)(i): The employer shall make available initial medical surveillance to employees occupationally exposed on any day to lead at or above the action level. Initial medical surveillance consists of biological monitoring in the form of blood sampling and analysis for lead and zinc protoporphyrin levels.  a.  On or about October 28, 2016, at the jobsite located at 218 E. South Island Street Appleton, WI, the employer did not make available initial medical surveillance in the form of blood sampling and analysis for lead and zinc protoporphyrin levels to employees prior to them being exposed to lead while removing lead based paint from various areas of the jobsite using abrasive blasting methods.
