OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; in that, an employee was exposed to a fall hazard;    a. On or about October 28, 2016, at the job site located at 2200 Caboose Ln. Odessa, FL., an employee was exposed to an approximate 41 foot fall hazard while being lowered to the ground on a wooden pallet on the forks of a SJ 643 TH rough terrain forklift.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    a) On or about 10/28/2016 at the roof top of building # 2200, an employee was exposed to a 41 ft. fall hazard while dismantling a ladder jack poles/towers from a 6 in 12 pitch roof, in that fall protection was not used.
