29 CFR 1926.1053(b)(3): Ladders shall not be loaded beyond the maximum intended load for which they were built, nor beyond their manufacturer's rated capacity.  1) Jobsite: The employer did not ensure the Werner extension ladder was not loaded beyond the maximum weight capacity, three-hundred pounds (300lbs.), thus exposing employees to fall hazards. Three (3) employees used the ladder at one time to access the roof.    Condition observed on/about 28 OCT 2016.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   1) Jobsite: The employer did not ensure employees installing a new roof of the Heatherwood Apartment building, approximately 25 feet from the ground below, were provided with fall protection. This condition exposed employees to fall hazards.   Condition noted on/or about 28 OCT 2016.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  1) Jobsite: Employer did not ensure employees wore eye protection, thus exposing employees to eye hazards. Employees working on the roof did not wear eye protection while using pneumatically powered nail guns.   Condition observed on/about 28 OCT 2016.  Employer History: The employer, under the company name of All Brothers Contracting, Llc, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1051492, citation number 1, item number 1 and was affirmed as a final order on 08/07/2015, with respect to a workplace located at 1041 3rd Street Whitehall, PA 18052.  The employer, under the company name of All Brothers Contracting, Llc, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.28(a), which was contained in OSHA inspection number 1068585, citation number 1, item number 1 and was affirmed as a final order on 09/09/2015, with respect to a workplace located at 1887 Schadt Avenue, Whitehall, PA 18052.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  1) Jobsite: The employer failed to provide adequate training for employees to recognize and mitigate fall hazards on the jobsite. Employees working on the roof of the Heatherwood Apartment building did not have fall protection training thus exposing them to fall hazards while working approximately 25 feet from the ground.  Condition noted on or about 28 OCT 2016.
