OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to a crushing hazard or death:    JOBSITE: The employer did not ensure through performing jobsite and task assessments by a competent person and providing specific training, instruction and visual observation that the employee using the external controls from the ground near the basket to move the Platform Basket aerial work platform (Platform Basket), Model 18.90 PRO & Serial Number PB9357, to a different location was performing the task safely at all times.        On or about November 2, 2016, while the employee was trying to bring the Platform Basket over the uneven ground surface and a concrete pad, the Platform Basket tipped over toward the employee, pinning the employee between the ground and the Platform Basket. The employee sustained serious injuries from the incident.
