29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:   Note:  As of January 1, 1998, body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:     In the yard behind the residential house,  while trimming trees, an employee was in an aerial lift elevated bucket mounted on the GMC 7500 truck, over 25 feet above that ground without using a body belt for fall restraint or a body harness for fall protection.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects:    In the yard behind the residential house,  employees were not wearing protective helmets while performing tree trimming operations and were exposed to struck by hazards from falling limbs.
