OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to tip-over hazards: (a) On or about November 02, 2016, and at times prior, Double Helix Construction, Inc. employees were exposed to tip-over hazards from operating a JLG Boom Lift, Model 80HX in a manner for which it was not intended by raising a 28 foot long, 128 lb. purlin on the platform railing approximately 21 feet high. Reference JLG Operation and Safety Manual, sub-section 1-7 that states "Do not carry materials on platform railing unless approved by JLG Industries Inc." and sub-section 4-1 that states "It must not be used as a forklift, crane, support for overhead structure, or to push or pull another object." Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated (a) On or about November 02, 2016, the employer did not ensure that employees were restrained within the Genie Boom S-85 aerial lift bucket to prevent ejection, while working at 6610 Holman St. Arvada, CO 80004, approximately 21 feet above ground. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
