29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  The employer is failing to protect employees from struck-by hazards in that; employees using pneumatic nail guns to apply shingles to a roof were not provided with eye protection.  This was most recently documented on or about November 16, 2016 at the Whispering Ridge Apartment Complex located at 3500 175th Ct, Omaha, NE 68116.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  The employer is failing to protect employees from fall hazards of approximately 40' eave to ground in that; employees were not tied-off to anchor points while re-roofing a four story apartment building, nor were they protect by other appropriate means of fall protection.  This was most recently documented on or about November 16, 2016 at the Whispering Ridge Apartment Complex located at 3500 N 175th Ct, Omaha, NE 68116.
