29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On or about November 30, 2016, and times prior thereto, at this facility, the employer had not established or implemented a respiratory protection program when employees were required to wear tight-fitting respirators when using the hazardous chemicals and materials for mixing, spraying, painting, sanding, grinding and scarfing the automotive parts. An effective respiratory protection program would include, but not limited to: a. Procedures for selecting respirators for use in the work place; b. Medical evaluation of employees required to wear respirators; c. Valid fit testing procedures for each type of tight-fitting respirators; d. Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding and maintaining respirators; and, e. Training of employees in the proper use of respirators.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about November 30, 2016, and times prior thereto, at this facility, employees involved in fabricating metal and plastic parts, sanding, grinding and scarfing those parts or when those parts are sprayed, lubricated and cleaned with hazardous chemicals such as, but not limited to, Acetone, Alcohols, Body Fillers, Urethane Activators, Thinners, Paints and Clear Coats. The employer had not developed a program which would address labeling and other forms of warning on chemicals containers, Safety Data Sheets and employees information and training on the hazards associated with chemicals used at this site. The written program must also contain the following: a. a list of all hazardous chemicals on site; b. the methods the employer will use to inform employees of the hazards associated with non-routine tasks involving chemicals, such as a spill; c. the hazards of chemicals contained in piping that is not labeled; and, d. the method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at this site.
