29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) 848 Central Parkway, Schenectady, NY - On Dec 3, 2016, employees were conducting roofing activities on a roof without fall protection.  An employee fell 11 feet to the ground below and later died.      Shear Contractors, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 280499, citation number 001, item number 1a and was affirmed as a final order on May 9, 2012, with respect to a workplace located at 1717 Campbell Ave, Schenectady, NY 12304.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours:  a) 848 Central Parkway Schenectady, NY - On December 3, 2016 at 8:30 am, an employee fell off a roof and was hospitalized. Employer did not report hospitalization until December 5, 2016 at 8:36 am.
