OSH ACT of 1970 Section (5)(a)(1): : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: the hazard of falling out of the bucket of a hydraulic excavator while it is being raised or lowered: Location: Construction site: 657 Saw Mill Rd, Ardsley, NY  a) on or about 11/28/2016, employee riding in the buck of a Komatsu excavator was exposed to falls of approximately 15 ft. from the bucket into a trench excavation.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  Location: 657 Saw Mill River Rd., Ardsley, NY  a) An employees was riding in the bucket of a backhoe due to no safe means of egress out of the trench /excavation.  The trench was over 5ft; on or about 11/28/16.
