29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. Jobsite: The employer did not ensure that the excavation, the adjacent areas, and protective devices/systems were inspected by a competent person prior to allowing employees to enter into the unprotected excavation/trench.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). Jobsite: The employees, working in an excavation that ranged in depth up to 16 feet deep were not protected from cave-ins by the use of appropriate cave-in protection system/device. On or about 10/10/2016, a side wall of the excavation/trench caved in, and an employee sustained multiple broken bones injuries from the incident.
