29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: On or about December 12, 2016, in the pallet yard the forklift being operated was in unsafe operating conditions. These conditions exposed employees to struck-by hazards. a) The brakes were not adjusted/functioning properly. b) The horn was not functioning. c) The front light was not functioning. d) No tag identifying the forklift's load capacity.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation: On or about December 12, 2016, in the pallet yard. The employer did not ensure that all forklift operators were certified, properly trained and evaluated in the operation of powered industrial trucks. This condition exposed employees to struck-by hazards.

29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment. On or about December 12, 2016, on the building floor, the electrical panel that provides electrical power to the building and equipment was not enclosed. The panel was missing the protecting circuit breaker cover and the panel door. This condition exposed employees to electrical shock hazards.
