29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  On or about August 4, 2017 the employer failed to certify to OSHA that the following hazards have been abated:  Citation 1, Item 1: On or about December 7, 2016, at 8340-8370 Village Place, Suwanee, Georgia, five employees performing framing work were exposed to struck-by hazards from wood chips and nails while operating nail guns without using eye protection.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET).

29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  On or about August 4, 2017, at 8340-8370 Village Place Suwanee, Georgia, the employer failed to submit documentation and certification of corrective action for Citation 1, Item 2, issued on January 30, 2017, that the following hazards have been abated:      On or about December 7, 2016, at 8340-8370 Village Place, Suwanee, Georgia:  a) Three employees performing framing work were exposed to fall hazards of approximately 18.6f-eet and greater while working from the top plate and trusses when they did not use fall protection.  b) An employee performing framing work on Unit 12, 8350 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he worked form the top plate without using fall protection.  c) Four employees performing framing work on Unit 11, 8340 Village Place, were exposed to a fall hazard of approximately 18.6-feet and greater after donning their fall protection harnesses but did not tie off to life lines while working from the top plate and within the trusses.  d) An employee performing framing work on Unit 12, 8350 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he worked from the top plate while wearing a harness but was not tied off to a life line.  e) An employee performing framing work on Unit 11, 8340 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he attached the connector of his lanyard directly to a knot in his rope life line.   f) An employee performing framing work on Unit 11, 8340 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he attached the connector of his lanyard directly to the rope grab mechanism which would have prevented the rope grab mechanism from engaging if the employee had fallen from the top plate and trusses.  g) An employee performing framing work on Unit 11, 8340 Village Place, was exposed to a fall hazard of approximately 10-feet and greater when he attached his rope grab lanyard to a lifeline that was attached to another rope grab lanyard which was used as an anchor.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about December 7, 2016, at 8340-8370 Village Place, Suwanee, Georgia:  a) Three employees performing framing work on Unit 11, 8340 Village Place, were exposed to fall hazards of approximately 18.6-feet and greater while working from the top plate and trusses when they did not use fall protection.  b) An employee performing framing work on Unit 12, 8350 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he worked from the top plate without using fall protection.   c) Four employees performing framing work on Unit 11, 8340 Village Place, were exposed to a fall hazard of approximately 18.6-feet and greater after donning their fall protection harnesses but did not tie off to life lines while working while working from the top plate and within the trusses.    d) An employee performing framing work on Unit 12, 8350 Village Place, was exposed to a fall hazard of approximately 18.6 feet when he worked from the top plate while wearing a harness but was not tied off to a life line.   e) An employee performing framing work on Unit 11, 8340 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he attached the connector of his lanyard directly to a knot in his rope life line.   f) An employee performing framing work on Unit 11, 8340 Village Place, was exposed to a fall hazard of approximately 18.6-feet when he attached the connector of his lanyard directly to the rope grab mechanism which would have prevented the rope grab mechanism from engaging if the employee had fallen from the top plate and trusses.   g) An employee performing framing work on Unit 11, 8340 Village Place, was exposed to a fall hazard of approximately 10-feet and greater when he  attached his rope grab lanyard to a lifeline that was attached to another rope grab lanyard which was used as an anchor and was attached to the framework of the house below the employee approximately 6-feet from the lower level which would not have prevented the employee from striking the lower level if he fell.
