29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    In the workplace located at 1920 13th Ave, Kearney, NE 68845 the employer is failing to protect employees from stuck-by and entanglement hazards while servicing and cleaning the Construction Machinery Company brand concrete batch mixer in that; the employer has not developed and implemented a program consisting of energy control procedures and training on how to isolate and control hazardous energy sources such as electrical energy to prevent the mixer drum from starting and creating an entanglement hazard and properly securing the gravel dump hopper to prevent it from swinging under the force of gravity and striking an employee working on the equipment.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.    On or about November 21, 2016, the employer failed to report to OSHA an in-patient hospitalization of an employee that within 24 hours of the incident.  This most recent occurrence of this took place at the facility located at 1920 13th Ave, Kearney, NE 68845 where on November 21, 2016 after an employee was injured from being struck by a gravel hopper that swung down from concrete batch mixer.  The employer did not report the incident to OSHA until December 1, 2016.
